Account & profile data
When you sign up we collect your name, work email, phone number, country, timezone, password (hashed via bcrypt), and any profile photo you upload.
Workspace & operational data
To deliver the Service we process: workspace name, connected WhatsApp numbers, broadcast templates, flow definitions, contact lists, team-member emails and roles, billing details, and audit-log events.
Customer message data
ChatKar stores the messages, attachments, and metadata that flow through your workspace. You are the data controller for this content; we act as a processor under our DPA.
Usage & telemetry
Anonymous usage events (page views, feature clicks, performance metrics) and standard server logs (IP address, browser type, request time) are captured for security and product improvement.
How we use your information
We use the data we collect to:
- Provide, maintain, and improve the Service
- Process payments, send invoices, and manage your subscription
- Respond to support requests and security incidents
- Detect, prevent, and address abuse, fraud, and security threats
- Send transactional emails (receipts, security alerts, product updates you opted into)
- Comply with legal obligations including tax, accounting, and law-enforcement requests
We never sell your data or your customers' data.
Sharing of information
We share data only in these limited circumstances:
- Sub-processors — AWS (hosting), Stripe (payments), SendGrid (email), Anthropic + OpenAI (AI features, redacted of PII). Full list at legal/subprocessors.
- Meta WhatsApp Cloud API — to dispatch messages on your behalf.
- Legal requirements — subpoenas, court orders, or to protect rights, safety, and integrity.
- Business transfers — in the event of a merger, acquisition, or sale of assets, with prior notice.
Cookies & tracking
We use first-party cookies for session management, security, and analytics. We do not use cross-site advertising cookies. Detailed list in our Cookie Policy.
Data retention
We retain personal data for as long as your account is active. After account termination:
- Customer data: exportable for 30 days, then deleted within 90 days
- Audit logs: 7 years for Scale plans (regulatory) or 12 months (other plans)
- Invoices & billing records: 10 years (tax law requirement)
- Backups: encrypted, fully purged within 90 days
Data security
We implement industry-standard safeguards:
- Encryption in transit (TLS 1.3) and at rest (AES-256)
- SOC 2 Type II certified (audited annually)
- ISO 27001 certified
- Mandatory 2FA for all staff with production access
- Quarterly third-party penetration testing

Your rights
Depending on your jurisdiction (GDPR, CCPA, India DPDP Act 2023) you may have rights to:

- Objection — opt out of certain processing

International transfers
Customer data is hosted in the region you select (EU, US, or India on Scale plans). Where data crosses borders we rely on Standard Contractual Clauses (SCCs) approved by the European Commission and supplementary measures for adequate protection.
Children's privacy
ChatKar is a business tool not intended for users under 18. We do not knowingly collect data from children. If you believe we have, email privacy@ChatKar.com.
Changes to this policy
Material changes to this Privacy Policy will be notified by email at least 30 days before they take effect. The "Updated" date at the top reflects the latest revision.

Welcome to ChatKar, a business communication, customer engagement, automation, marketing, and AI-powered platform operated by TVM Info Solutions Pvt. Ltd. ("TVM", "ChatKar", "we", "us", or "our").
This Privacy Policy explains how we collect, use, process, store, share, and protect information when you access or use ChatKar and its related services.
ChatKar may provide tools for WhatsApp and other messaging channels, customer conversations, contact and lead management, automation, AI-assisted communication, analytics, marketing campaigns, advertising integrations, CRM integrations, APIs, and other business communication services.
By registering for, accessing, or using ChatKar, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Privacy Policy, please do not use ChatKar.
1. What is ChatKar?
ChatKar is a software-as-a-service platform designed to help businesses manage customer communication and engagement.
Depending on your plan and enabled features, ChatKar may provide WhatsApp and social messaging, customer and team inboxes, contact and lead management, campaigns, broadcasts, chatbots, workflow automation, AI assistants, AI agents, analytics, advertising integrations, CRM integrations, APIs, mobile applications, and related business communication tools.
Features may vary depending on your subscription, configuration, third-party platform availability, and applicable laws.

Businesses using ChatKar may upload or process information relating to their customers, leads, employees, contacts, or other individuals.
Such information may include names, phone numbers, email addresses, messages, conversations, media, documents, recordings, notes, lead information, and other customer-generated content.
The business using ChatKar is generally responsible for determining what information it collects, why it collects it, how it uses it, and what permissions, notices, or lawful basis are required.
Customers are responsible for ensuring that they have the appropriate rights, permissions, notices, and lawful basis required to collect and process information through ChatKar.
Customers must not use ChatKar to process information unlawfully or to send communications that violate applicable laws, regulations, messaging policies, advertising rules, or third-party platform terms.
4. How We Use Information
We may use information to:
- Provide, maintain, and operate ChatKar.
- Create and manage user accounts.
- Authenticate users and protect accounts.
- Process customer communications.
- Manage contacts and leads.
- Deliver messages and notifications.
- Operate automation workflows and chatbots.
- Provide AI-powered functionality.
- Provide analytics, reporting, and recommendations.
- Process subscriptions, payments, invoices, and billing.
- Provide customer support.

5. WhatsApp, Instagram and Messaging Data
ChatKar may integrate with WhatsApp, Instagram, Facebook/Messenger, and other supported messaging or communication platforms.
Depending on the connected channel, ChatKar may process:
- Phone numbers and contact identifiers
- Messages and conversations
- Message status and delivery information
- Media and documents
- Templates and campaign information
- Conversation metadata
- Business account information
Third-party messaging platforms may independently collect, store, transfer, or process information according to their own terms, privacy policies, APIs, and infrastructure.
ChatKar does not control the privacy practices or infrastructure of third-party messaging platforms.
6. AI and Voice Features
ChatKar may provide AI-powered features including AI assistants, AI agents, automated replies, lead qualification, conversation analysis, summaries, recommendations, marketing content generation, and other AI-powered functionality.
Depending on the feature, AI processing may involve business information, product catalogs, pricing, customer messages, conversation history, prompts, instructions, documents, images, voice data, recordings, transcripts, and other information required to provide the requested functionality.
AI-generated content may not always be accurate, complete, or suitable for every situation. Customers should review AI-generated content where appropriate before sending or relying upon it.
Voice and Call Features
Where ChatKar provides calling, call recording, transcription, voice analysis, or related features, we may process audio recordings, transcripts, call metadata, summaries, classifications, and analytics.
Customers are responsible for providing any legally required notices and obtaining any required consent before recording or analyzing communications.
7. Third-Party AI and Service Providers
ChatKar may use third-party technology, cloud, AI, messaging, analytics, payment, security, and support providers to operate and deliver certain features.
Depending on the functionality being used, relevant information may be processed by third-party providers for purposes such as cloud hosting, AI processing, messaging delivery, analytics, customer support, email and notification delivery, payment processing, security, monitoring, advertising, and other services necessary to operate ChatKar.
We seek to limit information shared with third-party providers to information reasonably necessary for the relevant service or functionality, subject to applicable contractual, confidentiality, security, and data-protection requirements.
8. Billing, Payments and Tax Information
When you purchase a paid ChatKar plan or add-on, we may process information required to manage your subscription and billing.
- Company and business name
- Billing address
- GST or other applicable tax identification information
- Subscription and plan information
- Invoice information
- Transaction references
- Payment status
Where third-party payment processors are used, payment information may be collected and processed directly by the applicable payment provider according to its own privacy policy and security practices.
ChatKar does not need to directly store complete payment-card information where such information is handled by a third-party payment processor.
9. Integrations and Third-Party Services
ChatKar may integrate with CRM systems, e-commerce platforms, advertising services, spreadsheets, automation tools, payment providers, messaging platforms, analytics services, and other business applications.
When you enable an integration, ChatKar may access, receive, transmit, or process information according to the permissions and configuration you authorize.
Some integrations may require OAuth or similar authentication credentials. Such credentials are used to establish and maintain the authorized connection and are handled according to applicable security practices.
Third-party services have their own terms and privacy policies. ChatKar does not control the privacy or security practices of third-party services.

Do Not Track

Depending on the service and environment, safeguards may include:

- Security and incident-response procedures
No internet-based service, electronic transmission, cloud environment, or storage system can be guaranteed to be completely secure. Therefore, ChatKar cannot guarantee absolute security.
15. Data Retention and Deletion
We retain information only for as long as reasonably necessary for the purposes described in this Privacy Policy, including providing services, maintaining accounts, security, fraud prevention, legal compliance, accounting, dispute resolution, contract enforcement, and service improvement.
Retention periods may vary depending on:

- Security and backup requirements
When information is no longer required, we may delete, anonymize, aggregate, or securely isolate it.

This may occur through cloud infrastructure, messaging providers, AI providers, analytics providers, advertising platforms, payment providers, or other technology services.

Third-party platforms may independently process information according to their own infrastructure, terms, and privacy policies.

Where applicable, ChatKar will provide appropriate mechanisms relating to privacy notices, consent, withdrawal of consent, access, correction, deletion, security, grievance handling, and other legally required rights and obligations.

If you are located in the European Economic Area, United Kingdom, or another jurisdiction with specific privacy laws, additional rights may apply.
These may include rights relating to access, correction, deletion, restriction, portability, objection, consent withdrawal, and automated decision-making.
Where ChatKar processes information on behalf of a Customer, that Customer may have responsibility for responding to requests from its customers or end users.
20. Children's Privacy
ChatKar is a business-oriented platform and is not intended for children.
We do not knowingly solicit or intentionally collect Personal Data from children in violation of applicable law.
If you believe that a child has provided Personal Data to ChatKar without appropriate authorization, please contact us so that we can review the matter and take appropriate action.
21. Marketing and Communications
Service Communications
We may send account notifications, security alerts, billing notifications, product updates, support messages, and other communications necessary to operate ChatKar.
Marketing Communications
Where permitted by applicable law, we may send promotional communications about ChatKar, its products, features, services, events, and offers.
You may opt out of promotional communications using the unsubscribe mechanism provided in the communication or by contacting us.
Opting out of marketing communications does not prevent us from sending essential service-related communications.
22. Business Transfers
If TVM Info Solutions Pvt. Ltd. or ChatKar becomes involved in a merger, acquisition, financing, restructuring, sale of assets, sale of business, bankruptcy, or similar transaction, information may be transferred as part of that transaction.
Such transfers will be handled subject to applicable law and appropriate confidentiality and security requirements.

ChatKar may contain links to third-party websites, applications, platforms, or services.
Third-party services operate independently from ChatKar and may have their own privacy policies, terms, security practices, and data-processing activities.

ChatKar does not intentionally request sensitive Personal Data unless a particular feature expressly requires or supports such processing.
Because ChatKar processes business communications and customer-generated content, users may nevertheless submit information that could be considered sensitive under applicable law.
Customers must not upload or process sensitive Personal Data through ChatKar unless they have a lawful basis to do so, have obtained any required consent, such processing is permitted by applicable law, and the relevant ChatKar feature supports such processing.
Where sensitive information is processed incidentally through customer communications, it will be handled in accordance with applicable law and applicable contractual obligations.
25. Aggregated and De-Identified Information
ChatKar may create aggregated, statistical, or de-identified information from information processed through its services.
Where information has been properly aggregated or de-identified so that it can no longer reasonably identify an individual or Customer, ChatKar may use such information for analytics, security, product development, research, performance analysis, and service improvement, subject to applicable law.
26. Automated Decision-Making and Profiling
ChatKar may use automated technologies to assist with lead classification, conversation categorization, recommendations, analytics, customer segmentation, campaign optimization, and AI-generated suggestions.
Where applicable law grants individuals rights concerning automated decision-making or profiling, ChatKar will comply with those requirements.
Unless expressly disclosed otherwise, ChatKar AI tools are designed to assist users rather than independently make decisions producing legal or similarly significant effects about individuals.
27. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, technology, business practices, legal requirements, or regulatory obligations.
The latest version will be published through ChatKar and will include an updated "Last Updated" date.
